About these terms
These terms cover the Test Candidates website and candidate assessment service. The service is for employers and recruiters using assessments for business purposes, and for candidates invited to complete them. If you create an account for an organisation, you must have authority to act for it.
Test Candidates is operated by Neuroworx Ltd, registered in England and Wales under company number 14612373, with its registered office at 167-169 Great Portland Street, 5th Floor, London, W1W 5PF. Contact us at support@testcandidates.com.
A separate written agreement with your organisation takes precedence where it expressly changes these terms. Our privacy policy explains how personal information is handled; these terms do not reduce anyone’s data protection rights.
The assessment service
Employers can choose tests, invite candidates and review results. Assessments provide evidence to support recruitment decisions. They do not guarantee a successful hire or establish a candidate’s suitability on their own.
The employer is responsible for selecting relevant tests, giving candidates appropriate information, arranging reasonable adjustments and making lawful, fair recruitment decisions with human review. Consider assessment results alongside interviews and other relevant evidence. Personality assessments are not medical diagnoses.
Candidates should contact the inviting employer about the recruitment process or any adjustment they need. For technical help, contact Test Candidates support. Candidates are not charged for completing an employer’s assessment.
Accounts and access
Keep account and billing details accurate, protect passwords and invitation links, and only give access to authorised users. Your organisation is responsible for how its users use the service. Tell us promptly if you suspect unauthorised access.
Use the service lawfully. Do not interfere with another person’s assessment, obtain results without permission, distribute test questions or answers, bypass access controls, introduce malicious software, or resell the service without our agreement. These restrictions do not prevent rights that applicable law expressly allows.
Candidates must follow the assessment instructions and must not impersonate someone else or use unauthorised assistance.
Free candidate results
New per-candidate accounts receive the free candidate-result allowance shown at sign-up. This is a lifetime allowance for the organisation, not a monthly allowance or a time-limited subscription trial. No payment card is needed to use it. Creating duplicate accounts to obtain additional free allowances is not permitted.
The number of free results and the price applicable to your account are shown in the product. The pricing page describes the current offer for new accounts.
Per-candidate pricing and payment
For per-candidate accounts, charging is based on completed candidate results unlocked for your organisation, rather than the number of tests in an assessment. Sending an invitation alone does not create a candidate-result charge.
After your available free allowance is used, a valid payment method and an account eligible for paid unlocking are required to unlock further results. Enabling paid unlocking authorises the service to unlock eligible completed results and record the resulting usage, including eligible results already waiting to be unlocked as described in the confirmation shown to you. You do not need to make a separate purchase for each result.
Paid usage is billed monthly in arrears through Stripe. Monthly billing is a collection schedule, not an annual commitment or a fixed monthly platform fee. Your account’s unit price, currency and applicable taxes are shown before you enable paid unlocking. Prices shown to new visitors may differ from the price already assigned to an existing account.
You authorise Stripe to collect amounts due using your payment method. We receive payment references and limited billing and card details; full card details are handled by Stripe. Failed payments may be retried, and further paid unlocking may be paused until outstanding payments or authentication steps are resolved.
Stopping paid unlocking
You can stop future paid unlocking through your account’s billing controls. This does not reverse results already unlocked or cancel usage already incurred. Outstanding and final usage charges remain payable and may be collected when you stop or afterwards. Follow any confirmation or payment steps shown until the billing change is confirmed.
Stopping paid unlocking is separate from deleting your account or candidate data. Contact support if you need help closing an account or handling a data request.
Existing annual plans
If your organisation already has an annual plan, its agreed price, renewal date, included allowance and additional usage terms continue to apply until it ends or you confirm a change. The new-account per-candidate offer does not automatically replace those arrangements.
Where your account offers a switch to per-candidate billing, review the confirmation before proceeding. It explains when the old plan ends, how unused included credits are treated, any outstanding usage and the price for future candidate results. Switching does not refund an annual fee already paid. Stopping renewal normally preserves the existing plan until the confirmed end date; outstanding usage remains payable.
Any future retirement of an existing plan will be communicated separately. These terms do not backdate a price change or change a renewal date already agreed with you.
Billing questions and refunds
Contact support if a charge is incorrect or you believe the service has not been provided as agreed. Include the invoice reference, but do not send full card details. We will investigate and correct confirmed billing errors.
Stopping use of the service does not by itself refund valid charges for results already unlocked or an annual period already paid for. This does not limit any refund, remedy or other right available under applicable law or a separate written agreement.
Your information and confidentiality
Your organisation retains its rights in information and materials it submits. We may use that information to deliver, maintain and support the service and as described in the privacy policy. Submitting candidate data, assessment results or account information does not make it public or give us unrestricted rights to publish it.
You must have the necessary rights and lawful basis to supply candidate information and any uploaded material. Only upload information relevant to your use of the service. Do not include unnecessary sensitive personal information.
For candidate assessment data, the inviting organisation determines the recruitment purpose and how results are used. We process that data on its instructions. Any applicable data processing agreement governs that processing alongside data protection law. Contact support about data processing arrangements; this section is not a substitute for a data processing agreement.
Test content and results
We and our licensors retain rights in the platform and test content. You may use the service and the results made available to your organisation for your authorised recruitment purposes, subject to these terms. Do not publish or redistribute test questions, answer keys or other restricted assessment content.
Reports, browser observations and camera photos must be interpreted in context. No single observation or photo is proof of cheating. Camera photos are taken only when the organiser switches them on and the candidate allows camera access; they are not analysed automatically and are deleted six months after they are taken.
Availability and changes
We aim to keep the service available and accurate, but maintenance, technical faults and third-party outages can affect access. Report problems so we can investigate. No guaranteed uptime or service level applies unless separately agreed in writing.
We may update the service and these terms. Material changes affecting your account will be communicated before they take effect where required. A change does not remove rights relating to services already supplied or charges already incurred. If you cannot accept a proposed change, contact us about your options before continuing paid use.
We may restrict access where reasonably necessary to address misuse, a security risk, non-payment or a legal obligation. Where practicable, we will explain the reason and how to resolve it. Restricting access does not make personal information ours or remove your data protection rights.
Responsibility and liability
We will provide the service with reasonable care and skill. Employers remain responsible for their recruitment decisions, but that does not exclude our responsibility for our own legal obligations.
For business customers, we are not liable for indirect or consequential losses, or lost profits, revenue or business opportunities arising from use of the service. Our total liability arising from the service is limited to the fees your organisation has paid us for it, except where a separate written agreement states otherwise or the law does not permit that limit.
Nothing in these terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or right that cannot lawfully be excluded or limited. Candidates do not waive their statutory rights by completing an assessment.
Contact and disputes
Please contact support@testcandidates.com first so we can try to resolve a concern. These terms are governed by the law of England and Wales, and business disputes are subject to its courts. Any mandatory protections and jurisdiction rights applying to individuals remain unaffected.
